Agreement to terms and conditions

These terms and conditions form an agreement between you and the Diabetes Association of Western Australia Inc (ABN 77 867 587 369) (Diabetes WA). By visiting or using the websites at diabeteswa.com.au, getontrackchallenge.com.au, myhealthybalance.com.au or any other websites controlled by Diabetes WA (Websites), you agree to these terms and conditions. If you do not agree to these terms and conditions, do not use the Websites.

Changes to terms and conditions

From time-to-time, Diabetes WA may change these terms and conditions. Changes will be posted on the Websites as updated terms and conditions. Your continued use of the Websites will be taken as acceptance of the changed terms and conditions. If you do not agree with the changed terms and conditions, do not continue to use the Websites.

The terms and conditions as they appear on the Websites will constitute the entire agreement between you and Diabetes WA and supersede all previous terms and conditions.

Reliance on information

Use of the websites does not constitute the rendering of medical services or recommendations. While every effort is made to provide the most up-to-date and accurate information, Diabetes WA cannot, and does not, give any representations, guarantees or warranties regarding accuracy, appropriateness, completeness or currency of any information provided on the Websites.

Information presented on the Websites or provided through the Websites does not replace consultations with qualified health-care professionals to meet your individual medical needs.

By using the Websites you acknowledge and agree that you will be responsible for independently reviewing and confirming the accuracy, appropriateness, completeness and currency of any information that you obtain through the Websites which you intend to rely on.

Diabetes WA may provide professional healthcare advice during face to face consultations and on the Diabetes WA 1300 number, but the Websites cannot be considered to provide such advice. Limitation of liability

Diabetes WA does not accept any liability for any injury, loss (including consequential loss) or damage incurred by:

(a)    use or misuse of the Websites;
(b)    reliance on any information provided on the Websites;
(c)    participation in any program operated through the Websites; or
(d)    reliance on any information provided on websites which are linked to from the Website, as well as any privacy, security or other matters caused by or related to a website that is linked to from the Websites.


By agreeing to these terms and conditions, you agree to be bound by the Diabetes WA Privacy Policy, available on the Websites.
Use of information

In addition to the use of information outlined in the Privacy Policy, Diabetes Diabetes WA may use the information which you provide to us by using the Websites for the following purposes:

(a)    contacting you regarding the administration of any features or functions of the Websites;
(b)    where you have consented, sending you information, marketing and promotional e-mails based on our services or third party services;
(c)    allowing you to participate in the community features of the Websites;
(d)    responding to your questions or other requests;
(e)    tailoring your experience on the Websites;
(f)    saving your provided information so you don’t have to re-enter it each time you visit the Websites;
(g)    tracking your return visits to the Websites;

The trade marks “Diabetes WA”, “Get on Track”, “My Healthy Balance” and other names of Diabetes WA referred to in the Websites are trade marks of Diabetes WA. Other product and company names mentioned in this Website may be the trade marks of other people or entities. You must not use, modify, or permit the modification of any of the trade marks in any way.

Links from the Website

Links to any other websites are inserted for convenience only and do not constitute endorsement of material at those sites, or any associated organisation, product, service or information by Diabetes WA. The internet is an unsecured public network. You acknowledge and agree that information sent to or from the Websites, or third party websites linked to from the Websites, may be intercepted, corrupted or modified by third parties and that files obtained from or through the Websites, or third party websites linked to from the Websites, may contain computer viruses or other defects.


These terms and conditions do not create a relationship of employment, trust, agency or partnership between the parties.

Severability and survival

A provision or part of a provision of these terms and conditions that is illegal or unenforceable may be severed from these terms and conditions and the remaining provisions or parts of the provision of these terms and conditions continue in force. Any provision which, by its nature, is intended to survive termination of these terms and conditions survives termination of the agreement.

Governing law

These terms and conditions are governed by the law of the State of Western Australia and each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of Western Australia.
